Tesla Full Self-Driving (FSD) and Kentucky Insurance: Owner’s Guide (2026)

Tesla Full Self-Driving (FSD) and Autopilot don’t change your Kentucky insurance requirements or premium — but they do change how a claim gets handled if you’re in a wreck while the system is engaged. The legal responsibility, liability payout, and product liability question are three separate things. Here’s what Kentucky Tesla owners need to know.

Kentucky law treats you as the operator

Under Kentucky Revised Statutes, the driver operating a vehicle is legally responsible for its operation. Autopilot and FSD are SAE Level 2 driver-assistance systems requiring driver supervision. If you’re in a wreck while Autopilot or FSD is engaged, you are the operator under Kentucky law — the same as if you had been driving normally.

What this means for your insurance

  • Your auto policy responds normally. Liability, comp, collision, PIP, UM/UIM — all apply as they would in any other wreck.
  • Your policy premium doesn’t change because you have FSD. Kentucky carriers don’t currently differentiate rating based on FSD subscription status.
  • Your claim handling is the same. The adjuster’s process doesn’t change.
  • Your rate can go up after an at-fault claim. Kentucky rating doesn’t distinguish “driver was on FSD when it happened” from any other at-fault wreck.

Tesla’s data recording — helpful or harmful?

Tesla records extensive driving data — steering inputs, brake pressure, camera footage, Autopilot state, driver hands-on-wheel status. This data can be either helpful to your claim (proves you were doing the right thing) or harmful (shows you weren’t paying attention). Two things to know:

  • Tesla can share this data with insurance carriers and law enforcement under subpoena or with your consent.
  • You can request your own driving data from Tesla — it’s your right as the owner.

Product liability against Tesla — separate lawsuit

If FSD malfunctions and causes a wreck, whether Tesla bears any liability is a separate product liability question — not part of your auto insurance claim. Product liability lawsuits against Tesla can take years and require specialized attorneys. Your insurance still pays what it covers regardless of whether you pursue Tesla in parallel.

What FSD-owning Kentucky drivers should do

  • Higher liability limits. 250/500/250 or 300/500/300 recommended. FSD wrecks tend to involve highway speeds and multiple parties.
  • Umbrella policy essential. $1-2M umbrella at $200-$450/year adds critical protection.
  • Uninsured motorist matching. Kentucky’s UM rate matters more when you’re at highway speed.
  • Consider a dashcam beyond Tesla’s built-in. Additional third-party footage protects you if Tesla data is ambiguous.
  • Report software version at claim time. Auto insurance claims involving FSD should note the software version at the time of the incident.

Autopilot vs FSD — insurance-wise, same treatment

Kentucky carriers don’t differentiate between Basic Autopilot, Enhanced Autopilot, or FSD Beta at policy rating. All are Level 2 driver-assistance under SAE definitions, and Kentucky treats the driver as operator in all three cases.
